{"id":19981,"date":"2023-03-08T23:43:43","date_gmt":"2023-03-08T22:43:43","guid":{"rendered":"https:\/\/sdhjevicko.cz\/?page_id=19981"},"modified":"2023-03-08T23:43:43","modified_gmt":"2023-03-08T22:43:43","slug":"popis-fungovani-procesu-statniho-pozarniho-dozoru","status":"publish","type":"page","link":"https:\/\/sdhjevicko.cz\/?page_id=19981","title":{"rendered":"Popis fungov\u00e1n\u00ed procesu st\u00e1tn\u00edho po\u017e\u00e1rn\u00edho dozoru"},"content":{"rendered":"\n<p class=\"has-large-font-size\"><strong>kontroln\u00ed \u010dinnost<\/strong><\/p>\n\n\n\n<p>Jednou z oblast\u00ed v\u00fdkonu st\u00e1tn\u00edho po\u017e\u00e1rn\u00edho dozoru (d\u00e1le jen tak\u00e9 &#8222;SPD&#8220;) jsou kontroly dodr\u017eov\u00e1n\u00ed povinnost\u00ed stanoven\u00fdch p\u0159edpisy o po\u017e\u00e1rn\u00ed ochran\u011b, ukl\u00e1d\u00e1n\u00ed opat\u0159en\u00ed k odstran\u011bn\u00ed zji\u0161t\u011bn\u00fdch nedostatk\u016f a kontroly pln\u011bn\u00ed t\u011bchto opat\u0159en\u00ed. Kontroly jsou jedn\u00edm z n\u00e1stroj\u016f pro \u00fa\u010dinnou ochranu \u017eivota a zdrav\u00ed ob\u010dan\u016f a majetku p\u0159ed po\u017e\u00e1ry, co\u017e je z\u00e1kladn\u00edm posl\u00e1n\u00edm z\u00e1kona o po\u017e\u00e1rn\u00ed ochran\u011b a cel\u00e9ho HZS \u010cR.<br>Oblast kontroln\u00ed \u010dinnosti lze jako jedinou v r\u00e1mci v\u00fdkonu SPD ovlivnit \u2013 pl\u00e1novat (v\u00fdkon a mno\u017estv\u00ed \u00fakon\u016f v oblasti stavebn\u00ed prevence a zji\u0161\u0165ov\u00e1n\u00ed p\u0159\u00ed\u010din vzniku po\u017e\u00e1r\u016f jsou ur\u010dov\u00e1ny vn\u011bj\u0161\u00edmi vlivy a nelze je dop\u0159edu odhadnout). V r\u00e1mci \u0159\u00edzen\u00ed v\u00fdkonu st\u00e1tn\u00ed spr\u00e1vy na \u00faseku po\u017e\u00e1rn\u00ed ochrany stanovilo MV-G\u0158 HZS \u010cR krit\u00e9ria pro pl\u00e1nov\u00e1n\u00ed kontroln\u00ed \u010dinnosti HZS kraj\u016f (tzv. normativ kontroln\u00ed \u010dinnosti). Rovn\u011b\u017e na z\u00e1klad\u011b rozbor\u016f po\u017e\u00e1r\u016f a \u00fadaj\u016f z jejich dlouhodob\u00e9ho statistick\u00e9ho sledov\u00e1n\u00ed, podle aktu\u00e1ln\u00ed pot\u0159eby spole\u010dnosti, poznatk\u016f z anal\u00fdz nebo kontrol proveden\u00fdch v uplynul\u00e9m obdob\u00ed, ur\u010duje i zam\u011b\u0159en\u00ed po\u017e\u00e1rn\u00edch kontrol na p\u0159\u00edslu\u0161n\u00fd rok. Toto zam\u011b\u0159en\u00ed zohled\u0148uj\u00ed HZS kraj\u016f ve sv\u00fdch pl\u00e1nech po\u017e\u00e1rn\u00edch kontrol. V pr\u016fb\u011bhu roku jsou d\u00e1le ukl\u00e1d\u00e1ny kontroln\u00ed \u00fakoly dle aktu\u00e1ln\u00edch pot\u0159eb (nepl\u00e1novan\u00e9 mimo\u0159\u00e1dn\u00e9 po\u017e\u00e1rn\u00ed kontroly) nebo pot\u0159eba vznik\u00e1 v souvislosti s vy\u0161et\u0159ov\u00e1n\u00edm po\u017e\u00e1r\u016f. Tyto \u00fakoly jsou pln\u011bny na \u00fakor pl\u00e1novan\u00fdch kontrol, p\u0159\u00edpadn\u011b z jin\u00e9 oblasti v\u00fdkonu st\u00e1tn\u00ed spr\u00e1vy, nen\u00ed-li kapacita v dan\u00e9 dob\u011b pln\u011b vyt\u00ed\u017eena.<br>K po\u017e\u00e1rn\u00ed kontrole je zpracov\u00e1n program kontroly a o jej\u00edm pr\u016fb\u011bhu a v\u00fdsledku se sep\u00ed\u0161e&nbsp;protokol o kontrole.&nbsp;V protokole se uvedou&nbsp;zji\u0161t\u011bn\u00e9 nedostatky a stanov\u00ed se lh\u016fta pro pod\u00e1n\u00ed p\u00edsemn\u00e9 zpr\u00e1vy o odstran\u011bn\u00ed nedostatk\u016f.&nbsp;V p\u0159\u00edpad\u011b zji\u0161t\u011bn\u00ed&nbsp; poru\u0161en\u00ed povinnost\u00ed na \u00faseku po\u017e\u00e1rn\u00ed ochrany je vedeno spr\u00e1vn\u00ed \u0159\u00edzen\u00ed a vyd\u00e1no rozhodnut\u00ed o ulo\u017een\u00ed pokuty (nebo jin\u00e1 rozhodnut\u00ed). P\u0159i zji\u0161t\u011bn\u00ed poru\u0161en\u00ed povinnost\u00ed org\u00e1nem SPD spadaj\u00edc\u00edch do kompetence jin\u00e9ho spr\u00e1vn\u00edho \u00fa\u0159adu, jsou mu tato zji\u0161t\u011bn\u00ed postoupena formou podn\u011btu. Kontroly se rozd\u011bluj\u00ed na komplexn\u00ed, tematick\u00e9 a kontroln\u00ed dohl\u00eddky. P\u0159edm\u011btem tematick\u00fdch kontrol je kontrola pln\u011bn\u00ed vybran\u00fdch povinnost\u00ed a kontroln\u00ed dohl\u00eddkou se prov\u011b\u0159uje pln\u011bn\u00ed ulo\u017een\u00fdch opat\u0159en\u00ed.<\/p>\n\n\n\n<p><strong>Anal\u00fdza, fakta<\/strong><br>\u00a0<br>Po\u010det po\u017e\u00e1rn\u00edch kontrol nar\u016fstal postupn\u011b od roku 2001, v posledn\u00edch n\u011bkolika letech se tento trend t\u00e9m\u011b\u0159 vyrovnal, a to s nejv\u011bt\u0161\u00ed pravd\u011bpodobnost\u00ed v d\u016fsledku ust\u00e1len\u00e9ho po\u010dtu p\u0159\u00edslu\u0161n\u00edk\u016f vykon\u00e1vaj\u00edc\u00edch kontroln\u00ed \u010dinnost. Dlouhodob\u00e9 vyhodnocov\u00e1n\u00ed \u00fadaj\u016f HZS kraj\u016f o kontroln\u00ed \u010dinnosti, kter\u00e9 se zam\u011b\u0159uje na efektivitu v\u00fdkonu z hlediska vyt\u00ed\u017eenosti p\u0159\u00edslu\u0161n\u00edk\u016f vykon\u00e1vaj\u00edc\u00edch kontroln\u00ed \u010dinnost, vedlo v roce 2009 ke stanoven\u00ed nov\u00e9ho normativu pro v\u00fdkon v t\u00e9to oblasti. Na z\u00e1klad\u011b dostupn\u00fdch fakt\u016f byl stanoven minim\u00e1ln\u00ed po\u010det po\u017e\u00e1rn\u00edch kontrol 70 na 1 p\u0159\u00edslu\u0161n\u00edka za rok. Tento po\u010det je minim\u00e1ln\u00ed a je r\u016fzn\u00fd v z\u00e1vislosti na \u010dist\u00e9m fondu pracovn\u00ed doby na kontroln\u00ed \u010dinnost u ka\u017ed\u00e9ho p\u0159\u00edslu\u0161n\u00edka. Podrobn\u00fd postup je sou\u010d\u00e1st\u00ed pokynu gener\u00e1ln\u00edho \u0159editele Hasi\u010dsk\u00e9ho z\u00e1chrann\u00e9ho sboru \u010cR.<br><br>P\u0159i vlastn\u00edm v\u00fdkonu kontroln\u00ed \u010dinnosti se projevuje n\u011bkolik ne\u017e\u00e1douc\u00edch aspekt\u016f:<br>1.\u00a0Neuspokojiv\u00e1 \u00farove\u0148 \u010dinnosti stavebn\u00edch \u00fa\u0159ad\u016f z hlediska jejich ne\u010dinnosti na z\u00e1klad\u011b ozn\u00e1men\u00ed nedostatk\u016f spadaj\u00edc\u00edch do jejich p\u016fsobnosti (vady staveb) zji\u0161t\u011bn\u00fdch p\u0159i kontroln\u00ed \u010dinnosti. P\u0159esto\u017ee nedostatky jsou d\u016fsledn\u011b oznamov\u00e1ny m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00fdm stavebn\u00edm \u00fa\u0159ad\u016fm, v mnoha p\u0159\u00edpadech tyto \u00fa\u0159ady nekonaj\u00ed. T\u00edm je zt\u00ed\u017een v\u00fdkon po\u017e\u00e1rn\u00edch kontrol a n\u011bkdy a\u017e znemo\u017en\u011bna n\u00e1prava, nebo\u0165 HZS kraj\u016f nemohou zasahovat do kompetenc\u00ed jin\u00e9ho org\u00e1nu st\u00e1tn\u00ed spr\u00e1vy.<br>2.\u00a0Odborn\u00e1 \u00farove\u0148 osob s odbornou zp\u016fsobilost\u00ed na \u00faseku po\u017e\u00e1rn\u00ed ochrany, jejich\u017e prost\u0159ednictv\u00edm jsou provozovatel\u00e9 \u010dinnost\u00ed povinni plnit n\u011bkter\u00e9 povinnosti na \u00faseku po\u017e\u00e1rn\u00ed ochrany. Jakmile fyzick\u00e1 osoba z\u00edsk\u00e1 osv\u011bd\u010den\u00ed o odborn\u00e9 zp\u016fsobilosti, m\u016f\u017ee j\u00ed b\u00fdt odebr\u00e1no rozhodnut\u00edm MV-G\u0158 HZS \u010cR na z\u00e1klad\u011b n\u00e1vrhu org\u00e1nu SPD. Odborn\u011b zp\u016fsobil\u00e9 osoby nemaj\u00ed \u017e\u00e1dnou povinnost se d\u00e1le vzd\u011bl\u00e1vat. P\u0159esto\u017ee z v\u00fdsledk\u016f po\u017e\u00e1rn\u00edch kontrol a ZPP je zjevn\u00e9, \u017ee \u00farove\u0148 odborn\u00e9 pr\u00e1ce mnohdy nen\u00ed dostate\u010dn\u00e1, n\u00e1vrhy na odejmut\u00ed osv\u011bd\u010den\u00ed o odborn\u00e9 zp\u016fsobilosti konkr\u00e9tn\u00ed fyzick\u00e9 osob\u011b nebyly v posledn\u00edch 10 letech vzneseny.<br><br>Za roky 2001 \u2013 2009 bylo org\u00e1ny SPD provedeno celkem 107 703 po\u017e\u00e1rn\u00edch kontrol. Z nich bylo 11 940 komplexn\u00edch, 66 463 tematick\u00fdch a 29 300 kontroln\u00edch dohl\u00eddek. Sou\u010d\u00e1st\u00ed t\u011bchto kontrol byly i c\u00edlen\u011b zam\u011b\u0159en\u00e9 po\u017e\u00e1rn\u00ed kontroly s jednotn\u00fdm programem, kter\u00e9 vyhla\u0161uje MV-G\u0158 HZS \u010cR a v\u0161echny HZS kraj\u016f je zapracov\u00e1vaj\u00ed do sv\u00fdch pl\u00e1n\u016f po\u017e\u00e1rn\u00edch kontrol na p\u0159\u00edslu\u0161n\u00fd rok. Na roky 2002 \u2013 2009 (pro rok 2001 nebyly vyhl\u00e1\u0161eny) byly tyto kontroly zam\u011b\u0159eny celkem do 20 vybran\u00fdch oblast\u00ed. Z celkov\u00e9ho po\u010dtu po\u017e\u00e1rn\u00edch kontrol uskute\u010dn\u011bn\u00fdch v dan\u00e9m obdob\u00ed tvo\u0159ily c\u00edlen\u011b zam\u011b\u0159en\u00e9 kontroly 17,3 %. Vyhodnocen\u00ed t\u011bchto celorepublikov\u011b vyhl\u00e1\u0161en\u00fdch kontrol ukazuje na spr\u00e1vnost takov\u00e9ho postupu, proto\u017ee po\u010dty zji\u0161t\u011bn\u00fdch z\u00e1vad jsou neust\u00e1le vysok\u00e9 (cca 2,6 z\u00e1vad\/1 kontrola). Je v\u0161ak nutn\u00e9 zd\u016fraznit, \u017ee spln\u011bn\u00ed ulo\u017een\u00fdch opat\u0159en\u00ed minimalizuje po\u010det potenci\u00e1ln\u00edch rizik vzniku po\u017e\u00e1ru a jejich p\u0159\u00edpadn\u00e9 n\u00e1sledky a kontroly p\u016fsob\u00ed rovn\u011b\u017e preventivn\u011b. I podnikatelsk\u00e9 subjekty, u kter\u00fdch po\u017e\u00e1rn\u00ed kontrola nebyla provedena, se sna\u017e\u00ed b\u00fdt v maxim\u00e1ln\u00ed m\u00ed\u0159e na p\u0159\u00edpadnou kontrolu p\u0159ipraveni. Celkov\u00e9 po\u010dty proveden\u00fdch po\u017e\u00e1rn\u00edch kontrol zahrnuj\u00ed i mimo\u0159\u00e1dn\u00e9 (nepl\u00e1novan\u00e9) kontroly. V letech 2003 &#8211; 2009 byly mimo\u0159\u00e1dn\u00e9 kontroln\u00ed akce provedeny celkem v 9 oblastech. Tyto mimo\u0159\u00e1dn\u00e9 kontroly byly vyvol\u00e1ny:<br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">spole\u010denskou pot\u0159ebou (byly prov\u00e1d\u011bny na vy\u017e\u00e1d\u00e1n\u00ed v sou\u010dinnosti s Polici\u00ed \u010cR nebo s Gener\u00e1ln\u00edm \u0159editelstv\u00edm cel v letech 2003 a 2004),<\/mark><br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">mimo\u0159\u00e1dn\u00fdmi okolnostmi vznikl\u00fdmi v souvislosti s klimatick\u00fdmi podm\u00ednkami (mimo\u0159\u00e1dn\u00e9 p\u0159\u00edvaly sn\u011bhu nebo dlouhodob\u00e9 sucho),<\/mark><br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">v souvislosti s po\u017e\u00e1ry s tragick\u00fdmi n\u00e1sledky.<\/mark><\/p>\n\n\n\n<p>Od roku 2006 je sledov\u00e1n i po\u010det kontrol bez z\u00e1vad \u2013 dlouhodob\u011b se pohybuj\u00ed na \u00farovni cca 44 % z celkov\u00e9ho po\u010dtu po\u017e\u00e1rn\u00edch kontrol. Dokladuje to dobrou a p\u0159\u00ednosnou pr\u00e1ci v oblasti po\u017e\u00e1rn\u00ed prevence a preventivn\u011b v\u00fdchovn\u00e9 \u010dinnosti, p\u0159esto\u017ee snahou provozovatel\u016f \u010dinnost\u00ed i fyzick\u00fdch osob je vynakl\u00e1dat na po\u017e\u00e1rn\u00ed bezpe\u010dnost \u017e\u00e1dn\u00e9 nebo minim\u00e1ln\u00ed finan\u010dn\u00ed prost\u0159edky.<br>Ze zahrani\u010dn\u00edch zdroj\u016f vypl\u00fdv\u00e1, \u017ee vysp\u011bl\u00e9 st\u00e1ty maj\u00ed 1 p\u0159\u00edslu\u0161n\u00edka po\u017e\u00e1rn\u00ed prevence na 15 000 obyvatel. T\u00e9to \u00farovn\u011b po\u017e\u00e1rn\u00ed prevence v \u010cesk\u00e9 republice nedosahuje cca o 15 %. V sou\u010dasn\u00e9 dob\u011b nar\u016fstaj\u00edc\u00ed tlaky na dal\u0161\u00ed sni\u017eov\u00e1n\u00ed finan\u010dn\u00edch prost\u0159edk\u016f a po\u010dtu p\u0159\u00edslu\u0161n\u00edk\u016f m\u016f\u017ee v\u00e9st k dal\u0161\u00edmu zhor\u0161en\u00ed tohoto pom\u011bru a t\u00edm ke zhor\u0161en\u00ed celkov\u00e9ho v\u00fdkonu SPD a n\u00e1r\u016fstu po\u010dtu po\u017e\u00e1r\u016f se v\u0161emi dopady na ekonomiku st\u00e1tu. P\u0159i st\u00e1vaj\u00edc\u00edm po\u010dtu p\u0159\u00edslu\u0161n\u00edk\u016f a po\u010dtu ekonomick\u00fdch subjekt\u016f by mohla b\u00fdt provedena kontrola u stejn\u00e9ho subjektu zhruba za 200 let. Tyto \u00favahy vedou k pot\u0159eb\u011b stanovit kategorie vybran\u00fdch \u010dinnost\u00ed, u kter\u00fdch by byla stanovena ur\u010dit\u00e1 periodicita prov\u00e1d\u011bn\u00ed po\u017e\u00e1rn\u00edch kontrol. Stanoven\u00ed t\u011bchto kategori\u00ed \u010dinnost\u00ed a periodicity po\u017e\u00e1rn\u00edch kontrol je jedn\u00edm z c\u00edl\u016f koncepce po\u017e\u00e1rn\u00ed prevence.<\/p>\n\n\n\n<p><strong>Shrnut\u00ed<\/strong><br><br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">V posledn\u00edch n\u011bkolika letech se po\u010det proveden\u00fdch po\u017e\u00e1rn\u00edch kontrol stabilizoval v d\u016fsledku ust\u00e1len\u00e9ho po\u010dtu p\u0159\u00edslu\u0161n\u00edk\u016f vykon\u00e1vaj\u00edc\u00edch kontroln\u00ed \u010dinnost. Po\u017eadavky na dal\u0161\u00ed navy\u0161ov\u00e1n\u00ed po\u010dtu kontrol p\u0159i st\u00e1vaj\u00edc\u00edm po\u010dtu p\u0159\u00edslu\u0161n\u00edk\u016f by vedlo ke sn\u00ed\u017een\u00ed kvality na \u00fakor kvantity a ke sn\u00ed\u017een\u00ed po\u010dtu bod\u016f programu u jednotliv\u00fdch kontrol.<\/mark><br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">Dlouhodob\u011b vyrovnan\u00fd po\u010det kontrol bez z\u00e1vad dokladuje dobrou a p\u0159\u00ednosnou pr\u00e1ci v oblasti po\u017e\u00e1rn\u00ed prevence a preventivn\u011b v\u00fdchovn\u00e9 \u010dinnosti, p\u0159esto\u017ee snahou provozovatel\u016f \u010dinnost\u00ed i fyzick\u00fdch osob je vynakl\u00e1dat na po\u017e\u00e1rn\u00ed bezpe\u010dnost \u017e\u00e1dn\u00e9 nebo minim\u00e1ln\u00ed finan\u010dn\u00ed prost\u0159edky.<br>\u2022\u00a0Vysp\u011bl\u00e9 st\u00e1ty maj\u00ed p\u0159ibli\u017en\u011b 1 p\u0159\u00edslu\u0161n\u00edka po\u017e\u00e1rn\u00ed prevence na 15 000 obyvatel. T\u00e9to \u00farovn\u011b po\u017e\u00e1rn\u00ed prevence v \u010cesk\u00e9 republice nedosahujeme a v sou\u010dasn\u00e9 dob\u011b nar\u016fstaj\u00edc\u00ed tlaky na dal\u0161\u00ed sni\u017eov\u00e1n\u00ed finan\u010dn\u00edch prost\u0159edk\u016f a po\u010dtu p\u0159\u00edslu\u0161n\u00edk\u016f m\u016f\u017ee v\u00e9st k dal\u0161\u00edmu zhor\u0161en\u00ed tohoto pom\u011bru a t\u00edm ke zhor\u0161en\u00ed celkov\u00e9ho v\u00fdkonu SPD a n\u00e1r\u016fstu po\u010dtu po\u017e\u00e1r\u016f se v\u0161emi dopady na ekonomiku st\u00e1tu.<\/mark><br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">Nelze pravideln\u011b prov\u00e1d\u011bt po\u017e\u00e1rn\u00ed kontrolu u ka\u017ed\u00e9ho ekonomick\u00e9ho subjektu. Je proto nutn\u00e9 stanovit kategorie vybran\u00fdch \u010dinnost\u00ed, u kter\u00fdch by byla stanovena ur\u010dit\u00e1 periodicita prov\u00e1d\u011bn\u00ed po\u017e\u00e1rn\u00edch kontrol.<br>\u2022\u00a0P\u0159ehled intern\u00edch akt\u016f \u0159\u00edzen\u00ed a pracovn\u00edch pom\u016fcek souvisej\u00edc\u00edch s v\u00fdkonem kontroln\u00ed \u010dinnosti je uveden u procesu \u201e\u0158\u00edzen\u00ed st\u00e1tn\u00ed spr\u00e1vy\u201c.<\/mark><br>\u2022\u00a0<mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-luminous-vivid-amber-color\">Souhrnn\u00e9 v\u00fdsledky kontroln\u00ed \u010dinnosti jsou zve\u0159ej\u0148ov\u00e1ny ka\u017edoro\u010dn\u011b ve\u00a0<strong><a href=\"http:\/\/www.hzscr.cz\/statisticke-prehledy.aspx\">Statistick\u00e9 ro\u010dence<\/a><\/strong>. Dlouhodob\u011b sledovan\u00e9 \u00fadaje jsou vyhodnocov\u00e1ny a ka\u017edoro\u010dn\u011b p\u0159ed\u00e1v\u00e1ny v\u0161em HZS kraj\u016f k dal\u0161\u00edmu vyu\u017eit\u00ed. Jsou rovn\u011b\u017e za\u0159azov\u00e1ny do programu pravideln\u00fdch porad a IMZ organizovan\u00fdch centr\u00e1ln\u011b i na \u00farovni jednotliv\u00fdch HZS kraj\u016f. D\u00edl\u010d\u00ed v\u00fdsledky jsou vyu\u017e\u00edv\u00e1ny i v r\u00e1mci preventivn\u011b v\u00fdchovn\u00e9 \u010dinnosti.<\/mark><\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>stavebn\u00ed prevence<\/strong><\/p>\n\n\n\n<p>Stavebn\u00ed prevence je \u010dinnost\u00ed vykon\u00e1vanou v&nbsp;r\u00e1mci st\u00e1tn\u00edho po\u017e\u00e1rn\u00edho dozoru (d\u00e1le tak\u00e9 &#8222;SPD&#8220;), kde HZS \u010cR vystupuje jako dot\u010den\u00fd org\u00e1n pro \u0159\u00edzen\u00ed veden\u00e1 podle stavebn\u00edho z\u00e1kona. V\u017edy se jedn\u00e1 o v\u00fdkon st\u00e1tn\u00ed spr\u00e1vy na \u017e\u00e1dost, p\u0159i\u010dem\u017e mus\u00ed b\u00fdt dodr\u017eov\u00e1ny spr\u00e1vn\u00ed lh\u016fty k&nbsp;vy\u0159\u00edzen\u00ed pod\u00e1n\u00ed. MV-G\u0158 HZS \u010cR posuzuje stavby, kter\u00e9 se maj\u00ed uskute\u010dnit na \u00fazem\u00ed dvou nebo v\u00edce kraj\u016f nebo stavby, kter\u00e9 si vyhrad\u00ed. Ostatn\u00ed stavby posuzuj\u00ed m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00e9 HZS kraj\u016f. Jedn\u00e1 se o&nbsp;posuzov\u00e1n\u00ed stavebn\u00ed dokumentace u staveb definovan\u00fdch z\u00e1konem o po\u017e\u00e1rn\u00ed ochran\u011b z&nbsp;hlediska stanoven\u00fdch podm\u00ednek po\u017e\u00e1rn\u00ed bezpe\u010dnosti staveb. Posuzov\u00e1n\u00ed se prov\u00e1d\u00ed v&nbsp;rozsahu po\u017e\u00e1rn\u011b bezpe\u010dnostn\u00edho \u0159e\u0161en\u00ed podle zvl\u00e1\u0161tn\u00edho pr\u00e1vn\u00edho p\u0159edpisu, nebo v&nbsp;rozsahu obdobn\u00e9ho dokumentu, kter\u00fd je dostate\u010dn\u00fd pro posouzen\u00ed po\u017e\u00e1rn\u00ed bezpe\u010dnosti stavby.<\/p>\n\n\n\n<p>&nbsp;Z\u00e1kladn\u00ed podm\u00ednky po\u017e\u00e1rn\u00ed ochrany a po\u017e\u00e1rn\u00ed bezpe\u010dnosti staveb jsou stanoveny z\u00e1konem o po\u017e\u00e1rn\u00ed ochran\u011b a v&nbsp;podrobnostech vymezeny jeho prov\u00e1d\u011bc\u00edmi p\u0159edpisy (vyhl\u00e1\u0161ka o po\u017e\u00e1rn\u00ed prevenci a stavebn\u00ed vyhl\u00e1\u0161ka, na\u0159\u00edzen\u00ed vl\u00e1dy o kom\u00ednech, vyhl\u00e1\u0161ka o technick\u00fdch podm\u00ednk\u00e1ch po\u017e\u00e1rn\u00edch dve\u0159\u00ed) v&nbsp;n\u00e1vaznosti na kodex norem po\u017e\u00e1rn\u00ed bezpe\u010dnosti staveb \u010cSN 73 08xx a dal\u0161\u00ed navazuj\u00edc\u00ed \u010cSN. V\u00fdsledkem posuzov\u00e1n\u00ed podklad\u016f a&nbsp;dokumentace staveb a ov\u011b\u0159ov\u00e1n\u00ed, zda byly dodr\u017eeny podm\u00ednky po\u017e\u00e1rn\u00ed bezpe\u010dnosti staveb vypl\u00fdvaj\u00edc\u00ed z&nbsp;posouzen\u00fdch podklad\u016f, je z\u00e1vazn\u00e9 stanovisko nebo stanovisko dot\u010den\u00e9ho org\u00e1nu na \u00faseku po\u017e\u00e1rn\u00ed ochrany, kter\u00e9 je podkladem k dal\u0161\u00edmu \u0159\u00edzen\u00ed veden\u00e9mu stavebn\u00edmi \u00fa\u0159ady podle stavebn\u00edho z\u00e1kona. Z\u00e1vazn\u00e9 stanovisko v\u010detn\u011b uplatn\u011bn\u00fdch podm\u00ednek je pro m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00fd stavebn\u00ed \u00fa\u0159ad z\u00e1vazn\u00fdm dokumentem, kter\u00fd mus\u00ed b\u00fdt v&nbsp;r\u00e1mci \u0159\u00edzen\u00ed pln\u011b respektov\u00e1n. Posuzov\u00e1n\u00ed podklad\u016f a dokumentace staveb se t\u00fdk\u00e1 \u00fazemn\u011b pl\u00e1novac\u00ed dokumentace, podklad\u016f pro vyd\u00e1n\u00ed \u00fazemn\u00edho rozhodnut\u00ed, projektov\u00e9 dokumentace stavby ke stavebn\u00edmu \u0159\u00edzen\u00ed, dokumentace k povolen\u00ed zm\u011bny stavby p\u0159ed jej\u00edm dokon\u010den\u00edm a posuzov\u00e1n\u00edm dokumentace k \u0159\u00edzen\u00ed o zm\u011bn\u011b v&nbsp;u\u017e\u00edv\u00e1n\u00ed stavby, k&nbsp;na\u0159\u00edzen\u00ed nezbytn\u00fdch \u00faprav, k na\u0159\u00edzen\u00ed zabezpe\u010dovac\u00edch prac\u00ed, k \u0159\u00edzen\u00ed o zjedn\u00e1n\u00ed n\u00e1pravy a&nbsp;k&nbsp;povolen\u00ed v\u00fdjimky.<\/p>\n\n\n\n<p>Proti z\u00e1vazn\u00e9mustanovisku prvoinstan\u010dn\u00edho dot\u010den\u00e9ho org\u00e1nu na \u00faseku po\u017e\u00e1rn\u00ed ochrany m\u016f\u017ee b\u00fdt pod\u00e1no \u017eadatelem \u010di \u00fa\u010dastn\u00edky \u0159\u00edzen\u00ed odvol\u00e1n\u00ed, jeho\u017e opr\u00e1vn\u011bnost \u0159e\u0161\u00ed odvolac\u00ed (nejbl\u00ed\u017ee nad\u0159\u00edzen\u00fd) spr\u00e1vn\u00ed org\u00e1n, kter\u00fdm je MV-G\u0158 HZS \u010cR. Odbor prevence zpracov\u00e1v\u00e1 v\u011bcn\u00e1 stanoviska pro tato spr\u00e1vn\u00ed \u0159\u00edzen\u00ed.<\/p>\n\n\n\n<p>U dokon\u010den\u00e9 stavby, pokud se k&nbsp;jej\u00edmu projektu vyjad\u0159oval org\u00e1n SPD, prob\u00edh\u00e1 ov\u011b\u0159ov\u00e1n\u00ed, zda byly dodr\u017eeny podm\u00ednky po\u017e\u00e1rn\u00ed ochrany a po\u017e\u00e1rn\u00ed bezpe\u010dnosti staveb vypl\u00fdvaj\u00edc\u00ed z&nbsp;posouzen\u00e9 dokumentace, viz v\u00fd\u0161e, v\u010detn\u011b podm\u00ednek vypl\u00fdvaj\u00edc\u00edch z vydan\u00fdch stanovisek a p\u0159edlo\u017een\u00fdch podklad\u016f. V&nbsp;praxi to znamen\u00e1 u jednodu\u0161\u0161\u00edch realizac\u00ed minim\u00e1ln\u011b jednu fyzickou prohl\u00eddku stavby p\u0159ed jej\u00edm uveden\u00edm do u\u017e\u00edv\u00e1n\u00ed.<\/p>\n\n\n\n<p>\u00dasek stavebn\u00ed prevence poskytuje tak\u00e9 odborn\u00e1 stanoviska v&nbsp;r\u00e1mci spolupr\u00e1ce ministerstev a jin\u00fdch spr\u00e1vn\u00edch \u00fa\u0159ad\u016f, kter\u00e1 nejsou v\u00fdkonem SPD. D\u00e1le mo\u017enosti zpracov\u00e1n\u00ed dokumentace in\u017een\u00fdrsk\u00fdmi p\u0159\u00edstupy v\u00fdrazn\u011b zvy\u0161uje po\u017eadavky na odborn\u00e9 znalosti. T\u00edm se st\u00e1v\u00e1 situace nep\u0159ehlednou a komplikovanou, a nav\u00edc klade vysok\u00e9 n\u00e1roky na vzd\u011bl\u00e1v\u00e1n\u00ed jak p\u0159\u00edslu\u0161n\u00edk\u016f, tak projektant\u016f. Z \u00fa\u0159edn\u00ed povinnosti mus\u00ed b\u00fdt k projektov\u00e9 dokumentaci ka\u017ed\u00e9 stavby definovan\u00e9 z\u00e1konem o po\u017e\u00e1rn\u00ed ochran\u011b vyd\u00e1no z\u00e1vazn\u00e9 stanovisko, pop\u0159. stanovisko a n\u00e1sledn\u011b i stanovisko k uveden\u00ed stavby do provozu. Slo\u017eitost\u00ed projekt\u016f a variabilitou proveden\u00ed vzr\u016fstaj\u00ed po\u017eadavky na \u010dasovou dotaci tohoto v\u00fdkonu a na odbornou zdatnost. Z tohoto d\u016fvodu je mnohdy nutn\u00e9 tuto \u010dinnost v\u00edce \u201edotovat\u201c p\u0159\u00edslu\u0161n\u00edky vykon\u00e1vaj\u00edc\u00ed kontroln\u00ed \u010dinnost nebo vy\u0161et\u0159ov\u00e1n\u00ed po\u017e\u00e1r\u016f, co\u017e se projevuje v omezov\u00e1n\u00ed po\u010dtu kontroln\u00edch akc\u00ed.<\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>zji\u0161\u0165ov\u00e1n\u00ed p\u0159\u00ed\u010din vzniku po\u017e\u00e1r\u016f<\/strong><\/p>\n\n\n\n<p>Zji\u0161\u0165ov\u00e1n\u00ed p\u0159\u00ed\u010din vzniku po\u017e\u00e1r\u016f (d\u00e1le tak\u00e9 &#8222;ZPP&#8220;) je \u010dinnost\u00ed vykon\u00e1vanou v r\u00e1mci st\u00e1tn\u00edho po\u017e\u00e1rn\u00edho dozoru (d\u00e1le tak\u00e9 &#8222;SPD&#8220;). HZS kraje je jedin\u00fdm v\u011bcn\u011b p\u0159\u00edslu\u0161n\u00fdm org\u00e1nem k dan\u00e9mu \u00fakonu. Informace o vzniku po\u017e\u00e1ru p\u0159ed\u00e1v\u00e1 m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00e9 opera\u010dn\u00ed a informa\u010dn\u00ed st\u0159edisko HZS kraje ur\u010den\u00e9mu p\u0159\u00edslu\u0161n\u00edkovi pro ZPP (d\u00e1le jen \u201evy\u0161et\u0159ovatel po\u017e\u00e1r\u016f\u201c), kter\u00fd zpravidla vyj\u00ed\u017ed\u00ed na m\u00edsto ud\u00e1losti &#8211; po\u017e\u00e1ru. Na m\u00edst\u011b ud\u00e1losti vy\u0161et\u0159ovatel po\u017e\u00e1r\u016f prov\u00e1d\u00ed vy\u0161et\u0159ov\u00e1n\u00ed za \u00fa\u010delem zji\u0161t\u011bn\u00ed p\u0159\u00ed\u010diny vzniku po\u017e\u00e1ru a \u0161\u00ed\u0159en\u00ed po\u017e\u00e1ru, p\u0159\u00edpadn\u011b zji\u0161t\u011bn\u00ed poru\u0161en\u00ed p\u0159edpis\u016f, zaji\u0161\u0165uje listinnou dokumentaci, po\u0159izuje fotodokumentaci a dokumentaci audiovizu\u00e1ln\u00ed. Vy\u0161et\u0159ovatel po\u017e\u00e1r\u016f m\u016f\u017ee v od\u016fvodn\u011bn\u00fdch p\u0159\u00edpadech \u017e\u00e1dat o spolupr\u00e1ci Technick\u00fd \u00fastav po\u017e\u00e1rn\u00ed ochrany, chemick\u00e9 laborato\u0159e a org\u00e1ny Policie \u010cR.\u00a0 Spolupr\u00e1ce prob\u00edh\u00e1 na z\u00e1klad\u011b Dohody o sou\u010dinnosti mezi Hasi\u010dsk\u00fdm z\u00e1chrann\u00fdm sborem \u010cR a Polic\u00ed \u010cR. Ke spolupr\u00e1ci\u00a0 m\u016f\u017ee b\u00fdt p\u0159izv\u00e1n dal\u0161\u00ed org\u00e1n st\u00e1tn\u00ed spr\u00e1vy nebo jin\u00e9 osoby s pot\u0159ebnou odbornost\u00ed (znaleck\u00fd \u00fastav, soudn\u00ed znalec, apod.). P\u0159i dal\u0161\u00edm vy\u0161et\u0159ov\u00e1n\u00ed, kter\u00e9 ji\u017e nemus\u00ed prob\u00edhat na m\u00edst\u011b ud\u00e1losti, zji\u0161\u0165uje informace t\u00fdkaj\u00edc\u00ed se po\u017e\u00e1ru, stanov\u00ed verze p\u0159\u00ed\u010diny vzniku po\u017e\u00e1ru a prov\u00e1d\u00ed jejich prov\u011b\u0159ov\u00e1n\u00ed, pop\u00ed\u0161e \u0161\u00ed\u0159en\u00ed po\u017e\u00e1ru. Ve\u0161ker\u00e9 z\u00edskan\u00e9 informace zapracov\u00e1v\u00e1 do dokumentace o po\u017e\u00e1ru, v\u010detn\u011b zji\u0161t\u011bn\u00ed poru\u0161en\u00ed p\u0159edpis\u016f z oblasti po\u017e\u00e1rn\u00ed ochrany. Do dokumentace o po\u017e\u00e1ru pat\u0159\u00ed zejm\u00e9na spis o po\u017e\u00e1ru, jeho\u017e sou\u010d\u00e1st\u00ed je odborn\u00e9 vyj\u00e1d\u0159en\u00ed expertizn\u00edho pracovi\u0161t\u011b nebo znaleck\u00fd posudek soudn\u00edho znalce. Vy\u0161et\u0159ovatel po\u017e\u00e1r\u016f d\u00e1le zad\u00e1v\u00e1 informace o po\u017e\u00e1ru do programu Statistick\u00e9 sledov\u00e1n\u00ed ud\u00e1lost\u00ed a prov\u00e1d\u00ed rozbory p\u0159\u00ed\u010din vzniku po\u017e\u00e1r\u016f. P\u0159i zji\u0161t\u011bn\u00ed poru\u0161en\u00ed p\u0159edpis\u016f ukl\u00e1d\u00e1 pokuty v p\u0159estupkov\u00e9m \u0159\u00edzen\u00ed nebo ve spr\u00e1vn\u00edm \u0159\u00edzen\u00ed \u2013 proces spr\u00e1vn\u00ed a p\u0159estupkov\u00e9 \u0159\u00edzen\u00ed. V\u00fdsledk\u016f ZPP se vyu\u017e\u00edv\u00e1 p\u0159i likvidaci pojistn\u00fdch ud\u00e1lost\u00ed. V\u00fdsledky se vyu\u017e\u00edvaj\u00ed jako podklady pro n\u00e1vrhy regulatorn\u00edch opat\u0159en\u00ed, nap\u0159. formou pr\u00e1vn\u00edch p\u0159edpis\u016f, d\u00e1le se vyu\u017e\u00edvaj\u00ed pro stanoven\u00ed problematick\u00fdch oblast\u00ed pro v\u00fdkon kontroln\u00ed \u010dinnosti a v neposledn\u00ed \u0159ad\u011b pro preventivn\u011b v\u00fdchovnou \u010dinnost. N\u011bkter\u00e9 negativn\u00ed jevy p\u0159i vy\u0161et\u0159ov\u00e1n\u00ed po\u017e\u00e1r\u016f se projevuj\u00ed ve spolupr\u00e1ci s Polici\u00ed \u010cR, nebo\u0165 oba spr\u00e1vn\u00ed \u00fa\u0159ady pln\u00ed v danou dobu sv\u00e9 povinnosti na jednom m\u00edst\u011b, p\u0159i\u010dem\u017e maj\u00ed rozd\u00edln\u00e9 kompetence. Sou\u010dinnost obou slo\u017eek je o\u0161et\u0159ena&nbsp;<strong><a href=\"http:\/\/www.hzscr.cz\/soubor\/dohoda-s-pcr-pdf.aspx\">r\u00e1mcovou dohodou<\/a><\/strong>. Vy\u0161et\u0159ov\u00e1n\u00ed po\u017e\u00e1r\u016f je \u010dinnost\u00ed vysoce erudovanou, ka\u017ed\u00fd vy\u0161et\u0159ovatel mus\u00ed zn\u00e1t velk\u00e9 mno\u017estv\u00ed p\u0159edpis\u016f a sou\u010dasn\u011b mus\u00ed b\u00fdt schopen ur\u010dit p\u0159\u00ed\u010dinu vzniku po\u017e\u00e1r\u016f, co\u017e je pr\u00e1ce s kvalifikac\u00ed kriminalisty.
